Apple loses iPhone tradmark in Brazil

Thursday, February 14, 2013

Apple lost its iPhone trademark in Brazil, because it has been registered for a local company called Gradiente Eletronica since 2000 and it was approved in 2008, which means six years before the US Company.

Apple can continue to sell iPhone-branded handsets in Brazil, but that means Gradiente has an option of suing for exclusivity in South America's biggest market.

Of course Apple has already lodged an appeal against the decision with the Brazilian regulators, arguing that Gradiente's registration should be canceled because they didn’t use the name within a five year limit, where they didn’t release any product using iPhone name until December 2012, and the irony is it’s an Android handset.
